Q: I have an unpaid credit card in the UAE. I no longer live in the UAE. However, I am trying to make payments as best I can. ENBD has referred the account to a collection agency, who is, of course, threatening with civil action and a "lifetime" GCC travel ban. In the next few months, I will be able to clear up the account but I need some time after being unemployed since leaving the UAE 12 months ago. If this goes to the civil court, is it best to hire a lawyer to deal with this since I am not in the UAE?

Q: The bank is saying they will go for a civil case after I came out of the criminal case for a credit card cheque bounce. I have no money to pay. Will I be jailed? I am willing to pay the outstanding amount & dues if the bank can make for me instalment plan without a downpayment. The cheque amount was 55,000. Now, the amount including fines and dues is 77,000.

Q: Hi Mr Hari I have had a cheque bounce with one of the banks in Dubai which was an inbuilt cheque in credit card application. They had submitted a police case against me in April 2018. I was taken at Al Ragga police station. asked to pay AED 2000 fine. I was presented in front of the public prosecutor. I accepted that I am unable to pay the credit card amount and the bank did not tell me that they are submitting the cheque. I paid the fine on-spot and the passport was given to me. I also got my Police Clearance Certificate. Now to my surprise, after all this pain and harassment, the credit card fellow and so-called collecting agent are threatening to do a civil case. They are saying we will cancel all the extra interest charged on the card amount. Just clear the basic card value. I told them I was paying minimum payments earlier as well. But the bank did such a wrong thing by declaring me absconding. I have given 4 good years to this country. Please advise. If I do not take their calls and threats, what will be the worst case scenario?

Q: If I default to pay the loan amount (3 EMI), and my outstanding is 56000/-AED with a bank, can the bank put a case against me? And how much amount can they claim against me? Thanks

The provisions of this law, promulgating UAE Civil Code, govern the civil transactions in the United Arab Emirates. The commercial transactions remain subject to the laws and regulations applicable in their regard.

The provisions of this Decree by Law amend the Federal Law No. (18) of 1993 by replacing Clause (4) of Article (379) as well as Articles (600), (617), (641), (642), (643), (644), and adding new articles numbered (635) Bis, (641) Bis (1), (641) Bis (2), (641) Bis (3), (641) Bis (4), (643) Bis (1), (643) Bis (2), (644) Bis (1) and (644) Bis (2). The Decree-Law also repeals Articles (401), (402) and (403) of the Federal Law No. (3) of 1987.
