I have bounced cheques. Will Dubai Police consider this as a criminal offence?

Hello,

I have issued 3 cheques in the total amount of AED 46,000 as salaries for my worker and due to insufficient balance, 2 cheques have been bounced.

But recently, the same current account has been closed by the bank (Due to multiple cheques bounced). The third cheque he deposited last week and that cheque bounced due to account closing.

He is willing to file a police complaint and does not want to settle this amicably. I already obtained a letter from the bank that the bank itself closed the account.

My question is will Dubai Police consider this a criminal offense?

Any advice to resolve this matter would be appreciated.

According to recent legal amendments in the UAE, a bounced cheque due to insufficient funds cannot lead to a criminal case.

Instead, it can be pursued through the Execution Court for cheque execution case as per Article 667 of the Commercial Transactions Law.

However, if a cheque bounces due to a closed account, this can result in a criminal case under Article 675 of the same law. Legal action can also be taken for performance orders or cheque execution based on the recent high court ruling.

Yes, he can file a criminal as the cheque bounced due to the closure of the account, so it is better to settle with him amicably.
