القضية الجنائية المقامة من صاحب العمل بسبب قضية عمالية

أعطاني المدير السابق لي توكيلًا عامًا. إنه مدين لي شخصيا بمبلغ 300000 درهمًا إماراتيًا ورواتب 12 شهرًا. غادر البلاد في أحد الأيام.

اضطررت إلى رفع قضية لإلغاء تأشيرتي. طلب مني المدير بعد ذلك أخذ إحدى سياراته (باسمه الشخصي) ونقلها إلى اسمي وإنقاص قيمتها (25000 درهم إماراتي) من قرضه الشخصي الذي يدين به لي.

ربحت الآن قضية عمالية ضده وجاري تنفيذ الحكم. لقد فتح قضية جنائية ضدي بزعم أنني أخذت السيارة دون موافقته.

يفعل هذا من خلال محام لأنه ليس في البلاد منذ سنة. هل ستؤثر علي هذه القضية الجنائية؟ كيف يمكنني إثبات براءتي؟

Dear Questioner,

I am sorry to hear about your situation.

You have not mentioned whether the car transfer has actually been taken place or not.

If it has actually been taken place, there cannot be any criminal charge against you and your case will not get affected by that.

You have not mentioned when the judgement was drawn in favour of you. You may file execution if the same has been drawn before more than 30 days.

Dear Ma'am,

Many thanks for your kind advice.

The car is already transferred into my name using the General POA.

I have already won my labour case against the company and the execution is in process.

Now, my Boss (through his lawyer) has filed a case against me that the transfer of car was done without his permission (he gave me the permission verbally - over the phone).

The prosecution has forwarded a file to Dubai Police and the police have taken my statement and that of a witness as well (Witness in my favour).

I'm worried if a criminal case will be opened against me.
