Labour claim for dues and counter claim by the employer

Hi Hari,

I am currently working in Abu Dhabi. I had an employment contract with a Dubai company and It has been more than 8 months so far since I resigned.

I signed the settlement paper even though my settlement was not made. But I have a mail stating that I am signing this paper for cancellation and still yet to receive my dues.

I registered a complaint against my old employer and they are telling me that they will file a criminal case stating that I stole materials, I got a commission from suppliers and subcontractors, which is not true.

Please advise.

Thank you for getting in touch with me on this.

It appears that your labour complaint against the employer has triggered them into filing or threatening you with a false claim.

I would advise you to continue with your labour case and the company is merely threatening you with this false case.

In any circumstances, if the company does file the case, we will have to defend the same on merits.

In case we are able to prove that the case is wrongly filed, or filed with malicious intent, then we can claim compensation from the company for this false case.

As of now, I would advise you to focus on the labour case and get your rightful dues.

Hi Hari.

Thank you for your immediate reply.

How long will it take to provide a judgement on this case? I need to go to India in Jan 2019.

So is it possible to go outside the UAE while the case is in the court and if the employer claims the abovesaid allegations on me?
