Q: I left my room 9 months ago and handed over the key to real estate agency. My stay period was only 2 months and 13 days.
Now real estate agency is calling me and saying that I have to pay more money, otherwise, they will go to court... But the time I handed over the key, they did not return my security deposit and 20 days advance rent. Now after 9 months they are calling me...

Q: I issued a post-dated cheque in favour of someone. Now, I would like to change my bank account to some other bank.
Are there any legal issues in such cases?

Issue with rental cheques paid up front

Q: Sir,
I have released 7 post dated cheques for house renting on January 12. January 15 is the date of the 1st cheque which is valued 9k. But on January 15, my bank froze my account because my company terminated me. So I told them to not withdraw the cheque coz I got no money in it and I'm cancelling that property.
When I asked them I need to collect my cheque, they told me I cannot. Not unless I pay them 9000.
Do they have the right to do this? I am in a deep problem as they filed a case against me regarding this. So, I want to know.

Closing a bank account after drawing cheques

Q: Hello,
This is regarding a post-dated cheque given by my earlier landlord for the return of the deposit. I had cleared the apartment in May 2019 and he gave a cheque for March 2020.
Now he is saying that the account is closed and he will give cash but is still delaying. Can I deposit cheque and if it bounces, can I file a police complaint.
What do you advise?

1. The Lease Agreement for apartment rent states to be paid in 8 cheques. no mention of PDC or to give cheques in advance.
2. Lease does not specify that the cheques have to be given in advance or that they are to be PDC's.
3. I am up-to-date on my rent payments.
4. As the lease did not specify cheques to be given in advance, I give them on a timely basis as and when due.
5. The landlord is demanding that I give the balance cheques as PDC's and claiming it is a breach of contract.
6. The landlord is giving a 3-day notice to comply with the PDC's or else pay the full balance of the rent.
7. The landlord is refusing to give me the landlord's counter-signed lease copy.
8. I am neither in default nor behind on rent - how can he threaten me with a 3 days notice and demand PDCs when the lease did not ask for the same?

Changed my mind before signing the lease agreement. Are my post-dated rent checks at risk?

Q: Hello,
I recently found an apartment for rent and agreed with the agent to make payments in three installments.
I provided the agent with post-dated checks for the second and third payments and planned to transfer the first payment, deposit, and agency fee to the agent’s account once the lease agreement was finalized.
However, the lease agreement has not been finalized yet, and I have since found a better place. Since I have not signed any lease agreement, should I be concerned about the landlord cashing the checks for the second and third payments? Is it legal?
Additionally, the agent requested an extra 2,000 dirhams beyond the amount he intended to include in the lease agreement.
