Company hides leave balances. What is the UAE law regarding this?

Dear Sir/Madam,

Starting this year, my company decided to hide all previous annual balances of the employee from the system.

When I asked HR how many leave credits I have left before this year, I was told that they can only provide me with this information if I intend to leave the organization.

Is there anywhere in the UAE law stating that the staff has the right to know the exact days of annual leave she has, regardless of whether she will utilize it or not?

Or is it mentioned that the company has the right to withhold this information from the employee during tenure?

Currently, the system only shows the maximum 30 days allocation per year that the staff can take. Last year, the option to see everything was available.

Please help.

Thank you!

Dear Questioner,

As per UAE Labor Law, Article 13 clearly mentions the employer's obligation to keep the worker's files and records in accordance with the conditions, rules, and procedures issued by a decision from the Ministry.

This can be construed for the availability of the records to the employees too. If HR is still not disclosing the details, you can approach MOHRE to get the details of the same.

Dear Questioner,

Your company is required to inform you of the exact number of days of annual leave you have remaining.

If your company is not providing you with this information, you can file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE).

We can provide you with guidance and legal support for this situation.

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

In the UAE, there isn't a specific law stating that employees have the right to know their annual leave balance during their tenure.

However, transparency is generally expected, and many companies provide this information upon request. Review your employment contract and company policies for details.

If your company recently changed its practice regarding annual leave balance visibility, it's advisable to discuss your concerns with HR or management to understand the reasons for the change and whether exceptions can be made.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

We will be happy to help you.

We are pleased to serve you and address your inquiries.

The employee gets annual leave, at least two days per month for service over six months but less than a year, and 30 days per year for service over one year. The employee has the right to know all the details.
