Q: We are purchasing some taxable material from the UAE, and our main contractor agrees to pay this material cost on behalf of us. So, in which name should the supplier issue the Invoice, the name of our main contractor or our name? And also please clarify Input Tax Claim method.

Q: Hello, my husband is an engineer, and he is in Dubai since November 2, 2016. He is a foreign citizen from London. He did a contract with a company in Dubai (oil pipes). He got paid the 2nd week of November for the job that is supposed to be finished in 4 or 6 weeks. However, the job couldn't be done in time because the manager of the company did not provide him with enough employees and equipment to finish the job on time. This manager does not care if my husband has to remain there forever. Unfortunately, my husband travelled alone with my daughter because it was supposed to be for short time. On February 2017 my daughter got sick, and she was hospitalized. When my husband went to the offshore to pick up his staff he couldn't find his passport because the manager collected it from the offshore when my husband was in the hospital with my daughter. When he arrived, the police was waiting for my husband because the manager accused him of stealing money from his office which is not true.

Q: Hi, My mother was visiting Dubai and she slipped and fell as she stepped outside my sister's apartment. The floor outside the apartment was slippery and wet, the cleaners had removed the mat at the entrance of the door and failed to dry the floor or put any warning signs in that area. My mother suffered severe injuries, most serious being a fracture at the neck of the femur, which required a surgery. She did not have travel insurance. I approached the facilities management company about this, and they got the cleaning contractor to settle the hospital bill. However, my mother has a permanent rod and screw holding her hip and femur together and will never be the same again, so I want to claim compensation. Do I have a case to claim compensation for personal injury? Who is at fault, the facilities management company or the cleaning company who provides the cleaning service on their behalf? Both companies have been ignoring my letters about compensation.

Q: A Sub-Contractor (SC) holds/stops the work highlighting Article 246 & 247 [UAE Civil Code] due to payment delayed (Advance & Interim Payments) by the Main Contractor (MC). But the Main Contractor's concern is the document required to process Advance Payment [i.e. Advance Bank Guarantee - ABG] was not submitted on time & LC draft issued to SC was not agreed on time due to several arguments on some of its content. The MC paid the SC Advance Payment in 90 days from receipt of ABG highlighting the delay in reallocating the fund due to delay in ABG submission & LC draft agreement. Whose argument will withstand moving forward if MC intends to impose delay penalty on SC? Please advise. Thank you

Q: We are a contracting company based in Dubai. We entered into a contract with our client two years ago, the client released the advance payment at the start. They have caused delays at the site due to which we weren't able to proceed with the work for this duration. We were recently invoiced charges for the delay but they aren't ready and are now trying to terminate us from the contract. They are asking us to repay the advance payment made in 2018 April. Our contracts do not carry any clauses for the security of advances or liquidated damages. Can they still claim back the advance even though we were not the ones responsible for causing the delays? What are the options we have to move forward with this situation?

Q: Greetings, We have issued a Letter of Purchase Order (LPO) to our subcontractor for a project. The payment from the main contractor has been delayed. To speed up the process, we have asked the main contractor to pay the subcontractor on our behalf through a No Objection Certificate (NOC). Since the LPO is from our company, the subcontractor has asked us to give a security cheque in case the payment is further delayed. We have issued the cheque along with a letter stating that they have to return the cheque upon receiving the cheque from the main contractor. The guarantee cheque was used after 3 months even after getting the payment from the main contractor. The subcontractor has started communicating with the main contractor without keeping us in the loop. Due to cash flow problems, we were supposed to leave the project. Can I approach the court asking for the same/twice the amount as compensation due to a breach of trust and a similar amount as a conflict of interest?
