Raising the rent because the tenant is modifying the original payment terms

Dear Sir/Madam,

I have issued a tenant renewal notice with the same rent as the tenant is not eligible for a rent increase. However, the tenant is requesting to modify the payment terms from 4 cheques to 6 cheques.

In this scenario, can I increase the rent since the tenant is altering the original payment terms of the contract?

Dear Questioner,

If your property is in Dubai, you can increase rent according to the RERA rental index, but please note that any amendments to the tenancy contract shall be made within 3 months of notification before renewal.

Both parties can decide whether to accept the changes or not. Only mutually accepted terms will stand in new contracts.

Sir, it's up to you; if you want to accept the 6 cheques payment, it's OK. If you don’t want to, just refuse.

To increase the rent legally, you need to inform the tenant 3 months before the end of the rent contract.

Now you can not increase the rent but also you can reject the 6 cheques request.

Here, the terms of a tenancy contract can be changed before 90 days of renewal by a notification by the party with mutual consent.

If the tenant accepts this, then you can increase or change the payment terms. Otherwise, it's not possible under the law.
