Will our company be liable for accidents of workers who are sponsored by another company?

Hi,

I am running a startup company in a home renovation business. We have some laborers coming on a daily basis and working on the site and they are paid on a daily basis.

Our company is not their sponsor and we simply hire them for a few days to do some labor work.

The question is during the work (e.g., while drilling or demolishing) if something happens to one of these laborers, will we be responsible?

given they are not directly employed or sponsored by us, should they have their own health insurance while working?

How can we protect the business?

Dear Client,

Thanks for your question, I hope you are doing well. I will definitely assist you in this matter.

In the UAE, even if you hire laborers on a daily basis for your startup, you are responsible for their safety and should ensure a safe work environment.

While they may not be your direct employees, it's wise to provide health insurance coverage for them, as accidents can happen.

Clear written agreements, liability insurance, and compliance with labor laws are essential to protect your business.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

We will definitely be happy to help you.

Thanks & Regards

If these workers are working under your supervision and directions, then you are responsible for their safety.

Any problems can be avoided by requiring them to use all safety measures, such as wearing a helmet, wearing gloves, and placing occupational safety signs on the site.

In the scenario you've described, where hired laborers are engaged on a temporary basis, it's important to address potential liability concerns.

While I am not providing formal legal advice without a comprehensive consultation, I can offer some general insights.

In many jurisdictions, including Dubai, businesses can have liability even if workers are not directly employed or sponsored.

Various factors, such as the nature of the work and the level of control exerted over the laborers, can impact the legal responsibility of the company.

To protect your business, consider the following steps:

Contractual Agreements: Ensure that you have clear and comprehensive contracts with the laborers outlining the scope of work, safety protocols, and any indemnification clauses.

Insurance Coverage: While the laborers may not be directly employed by your company, it's advisable to check if your business insurance covers third-party liability or accidents on the work site. Additionally, encourage laborers to have their own health insurance.

Safety Protocols: Implement and enforce strict safety protocols on the work site. Regular safety briefings and proper training can reduce the risk of accidents.

Documentation: Maintain detailed records of the hired laborers, their qualifications, and any safety training provided. This documentation can be valuable in the event of a legal inquiry.

For a more personalized assessment and advice tailored to your specific situation, I recommend scheduling a consultation.

Please feel free to reach out to me via WhatsApp or phone. I would be happy to discuss your concerns in more detail.

Employers in the United Arab Emirates (UAE) have a range of responsibilities towards daily wage workers, also known as temporary or casual workers, under the UAE Labor Laws.

These responsibilities ensure that daily wage workers receive fair treatment, protection, and compensation.

The employer's liability will exist even though the workers have their own health insurance.

If you want more clarification we will arrange a legal consultation session for a charge. Share your WhatsApp number if you want to go with our services.
