Settlement of credit card overdues to avoid legal action

Dear M.,

With reference to your query, In order to be more precise, I need to understand how much is the pending amount? Since when is it overdue? How much interest has been imposed? Have you been contacted by the collection department or by the court?

If the credit card payment is long overdue, then my advice shall be to consult a lawyer to inquire about the police complaints and cases that have already been filed against you.

That will give you the opportunity to negotiate appropriately with the banks and help you in planning your move accordingly. Prior due diligence will prevent you from falling into any tricks.

In general, my advice shall be to negotiate with the banks directly in order to settle the matter in the first place.

If the bank agrees to settle the matter, you can obtain a clearance certificate from the court and your case can be removed thereafter.

In case no settlement is reached between both parties, the police case will be filed against you which will impose a travel ban on you. Then the bank will have to institute a civil case to recover its dues.

The option to settle the overdue amount exists at all stages of the case. If you want, then you can appoint a lawyer who can negotiate the terms for payments/ instalments on your behalf.
