Q: Hi Mr Hari
I have had a cheque bounce with one of the banks in Dubai which was an inbuilt cheque in credit card application. They had submitted a police case against me in April 2018.
I was taken at Al Ragga police station. asked to pay AED 2000 fine. I was presented in front of the public prosecutor. I accepted that I am unable to pay the credit card amount and the bank did not tell me that they are submitting the cheque.
I paid the fine on-spot and the passport was given to me. I also got my Police Clearance Certificate.
Now to my surprise, after all this pain and harassment, the credit card fellow and so-called collecting agent are threatening to do a civil case.
They are saying we will cancel all the extra interest charged on the card amount. Just clear the basic card value. I told them I was paying minimum payments earlier as well.
But the bank did such a wrong thing by declaring me absconding. I have given 4 good years to this country.
Please advise. If I do not take their calls and threats, what will be the worst case scenario?

I have a credit card cheque bounce case of AED 57,000. I've already paid the fine of AED 2020 in the police station but the bank is still calling me a for the payment of AED 57,000.
They told me they're filing a civil case against me. Please tell me about the further procedure if they file a civil case, and if there is any travel ban or any other fine on me.

Negotiating with banks in respect of outstanding dues

Q: Hello.
I owe a bank here in the UAE a credit card debt amount.
Due to circumstances (losing my main source of income, having other financial burdens, including monthly medical bills for cancer treatment & medications etc., and I don't have health insurance), I haven't been able to pay back on time since over a year ago.
Hence, that amount has since accumulated from a small figure to a relatively big one (currently at around AED 70,000).
I have received an email recently from some "credit collection" agency, saying that if I don't pay back next month, they'll put a travel ban on me and file a civil case. However, it is impossible for me to pay this amount at this time.
I am currently making "some" income (not as close as I used to before, but still), and have the intention to resolve this issue.
Is there any way to reach a settlement with the bank (maybe to waive part of the amount or the interest), break down the monthly installments to smaller amounts, or any other solution you would suggest?

Civil case for a bounced cheque after closing criminal case

Q: Last year in April 2018, one bank filed a criminal case against me for not paying the credit card. I have settled it in the police station and paid the fine for AED 2020.
The police said the case is already closed. The bank cannot present the same cheque to file another case against me.
And after 1 year, one law firm contacted me chasing for the unpaid dues from that bank and said they will file a case against me.
Can this be possible? And what case can they file?

Legal consequences for non payment of bank dues

Q: Dear Sir
My question is that I have two credit cards of a total outstanding amount of AED 60000 including interest and late fines...etc. I am not paying the credit cards payments for the last six months due to financial issues.
I contacted the bank for full and final settlement after giving a discount but the bank has not agreed to give a discount and asking to pay the full outstanding amount.
What would be the legal consequences in case of not paying the cards payment?
Please advise how to settle and close these issues.

How to settle a civil case for credit card default after paying fine

Q: I have some credit card defaults and I went to prosecution and cleared the bounced cheque with fine payment 2 years back. Now collections agency is mailing to HR, threatening via Whatsapp & phone calls.
The bounced cheque amount was 55K. Now the agency is asking nearly 300k. I understand the civil liability but what is the way out of this? Can they file a civil case and make a travel ban?

One of my relatives lost a civil case (final judgment) with a bank around 3-4 years ago, the total amount is around 9 million dirhams. There are 3 people who have been asked to pay this amount.
He does not have the full amount but is willing to make some payments, is it possible to negotiate the amount and get the case finished?

How to stop the debt collection agency from harassing me at my workplace?

Q: Hi,
I would like to ask if it is allowed for any debt collection company to send emails to multiple persons in my company which is HR, the CEO, and other colleagues of mine regarding the liability I have.
Also, they keep on calling my workplace and keep on shouting at the reception to transfer the call directly to our HR Department. I would really appreciate it if someone can advise me on this matter.
