Disputing tenant's refusal to accept old landlord's rent increase notice

Hi,

We recently bought a villa in Dubai. We are looking for an advocate for legal advice.

Even though the old owner gave the tenant a 90-day notice about the new rent, the tenant is not agreeing to the notice because it didn't come from us.

Since the renewal is in October and we bought the property in September, we don't have 90 days to notify the tenant of the new rent.

The tenant agreed to the new rent in an email with the old owner 90 days ago. Can we dispute this?

Ownership transfer does not affect the legal status, meaning that the current owner replaces the previous owner in all rights and obligations.

As the current owner, you benefit from the notifications sent by the old owner.

Hello,

Actually, you have the right to evict him but the old owner did not follow the right process.

Firstly, he should send a notice for 12 months and then, you also need to send another notice to emphasize the old notice sent by the old owner.

Hello

You still can use the old notice of previous landlord if it was sent correctly and within the 90 days time.

If the tenant not agreed you have the right to evict him.

In your situation, since the tenant has agreed to rental increase in writing to the old landlord you can file a complaint in RERA if the rental increase is in pursuant to the Rental Index.

Yes, even though the property has been transferred to the new owner he is getting into the position of the old landlord.

So the tenant is obliged to pay the increased rent as he is agreed upon the email communication.
