How can I get a refund of the first rent payment if the unit does not match the description?

I wanted to rent a unit and booked an appointment in Sharjah for Friday (08/09). As I arrived there, he showed me another unit which looked awful and told me only then the one I asked for was already rented.

I was so tired and confused, that I agreed to rent that unit if he could get me the Ejari by Monday which he confirmed. I signed an empty contract in the agent’s office on Friday evening in Dubai and he promised me to fill out the necessary fields.

Someone cashed in my first cheque of AED 7370 already on Saturday when I still haven't got a contract signed by the owner. On Sunday, I had to get to Sharjah again to meet the owner.

However, only his manager was there and the agent let me sign a second contract (different contract number) which had only the unit number on it.

The owner signed a 3 copies contract only on Monday (11/09) evening and the agent wanted me to drive there and sign it which I haven't done.

My question is can I get my money back and what should I do for it?

Thanks

Dear Khaled,

Thanks for the prompt reply!

However, with the 1000 characters' limitation, I could not give you the whole picture, and therefore your answer is not really applicable.

Here is a more detailed description. Can you please also give me a fixed price quote to resolve this matter?

I arrived in the UAE on 07/09 and wanted to stay 90 days to be able to apply for the tax residency this year.

My plan was to rent a furnished unit for this time, but shortly before my flight I realized that I would not get Ejari (what was also needed for the tax residency) with a 3-month lease, I have to rent a unit for a year.

I looked at some units in Dubai and booked an appointment in Sharjah for Friday too.

I let the agent confirm our appointment on Friday again but as I arrived, he showed me another unit that looked awful and told me only then the one I asked for was already rented.

I was so tired and confused, that I agreed to rent that unit if he could get me the Ejari by Monday (11/09) which he has confirmed.

I signed an empty contract in the agent’s office on Friday evening in Dubai and he promised me to fill out the necessary fields (photo).

Someone cashed in my first cheque of AED 7370 already on Saturday when I still haven't got a contract signed by the owner.

On Sunday (10/09) I had to get to Sharjah again to meet the owner. However, only his manager was there and the agent let me sign a second contract (different contract number) which had only the unit number on it (photo).

I reminded the agent on Sunday evening and on Monday again, that I needed the Ejari on Monday but the owner signed a 3 copies contract only Monday (11/09) evening and the agent wanted me to get there and sign it which I haven't done.

It has only Arabic text/special condition.

My most important question is if I can get my money back and what should I do about it (I’ve got proof for all the above as WhatsApp messages and photos taken).

I’m still using my Australian Whatsapp number.

You should obtain a copy of the contract you signed and read the terms regarding the refund.

I advise you to never sign any blank document before you have verified all the terms.

I've got a copy (photo) of the empty contract with only my signature.

Agree, I'll never sign an empty contract - I've trusted the agent.

Initially, you can request a refund in the event that what you agreed upon is not what is presented to you.

So to answer you correctly, please provide me with pictures of documents and conversations by phone.
