We bought an apartment and the previous owner served an eviction notice. Can the tenant refuse to leave?

Hi,

We bought an apartment in July. The apartment is rented until the end of November with the previous landlord who gave them an eviction notice last year to sell the house.

Now they want to renew the contract but we don’t want to renew because we want to move into our apartment to live there.

Can we move into our apartment and the tenant has to go out?

Can the tenant refuse to move out?

Hi,

Since the reason for eviction has changed, it is better that you serve them a legal notice for occupying the apartment.

Also, it would be helpful if you could share the legal notice served by you on our phone.

Dear Client,

Thanks for your question, I hope you are doing well. I will definitely assist you with this matter.

As the new owner, you must honor the existing lease until it expires. After the lease ends, you can choose not to renew it and request that the tenant vacate the property.

If the tenant refuses to leave, you may need legal assistance to initiate eviction proceedings following the UAE rental laws.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

We will definitely be happy to help you.

Thanks & Regards

Greetings from SKILLS LEGAL CONSULTANTS

The tenant has to move out. If this is refused, an eviction case must be registered.

He will be evacuated.

Please consider the legal notice that was sent to him in advance meets the legal requirements and is valid.

If you want to move into the apartment and you don't have a place other than this one to stay then the tenant has to evict from the apartment.

The legal notice sent by the previous landlord is valid in this sense.

Hi

You can ask the tenant to move out in accordance with the notice served by the previous landlord as you have to move into the apartment and refuse its renewal.
