Q: My husband is selling icecreams in a cafe in Dubai. He has started a business from this. He needed a visa and the owner gave him a visa but we paid for it. The owner wrote a contract by email but we haven't signed it. We have given 3 cheques for the next year and are paying quarterly. Unfortunately, the business/icecreams are not selling at all and we want to get out of the contract. I would like to know what hope do we have to get out of the contract as we haven't signed it but he has the year cheques on him. Hope to hear from you soon.

Q: I gave 12 guarantee cheques against salon rent. The first month, they deposit the cheque without information and collected the amount. The second time, we gave cash by hand and collected the cheque. But before the third time, we asked for an agreement for the salon. They said later. So when we realized they cannot give the agreement, we said we are leaving the salon and requested all cheques since there is no agreement. They refused and deposited and collected the amount. So I asked again and again and they are not ready to return the cheque and we already stopped work in the salon. Later, we reported in the police station the loss of the cheque and we asked the bank to stop the payment. But now they made a case against me for 20000 for bounced cheque due to stopping the payment of the cheque. How can I get a solution for this case?

Q: We are asked to give an undated security cheque in lieu of the payment done for provided services, how to write this cheque? Can we mention "Security Cheque" on the face of the cheque?

In the UAE, cheque bounce is a very frequent problem faced by people during their span in the country. It is covered under the purview of Commercial Transactions Law, and legal implications/penalties can be financially severe and daunting for more “serious” offenses. Bounced cheque issues may arise in a variety of commercial transactions, including but not limited to, companies’ exchanges, bank loans, property rents or purchases, and individual transactions.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.
