هل يمكنني إخلاء المستأجر عندما أشتري عقارًا جديدًا بقصد تأجيره بسعر أعلى؟

مرحبًا،

هذا هو وضعي الحالي:

لقد اشتريت للتو عقارًا، وأصدر المالك السابق إخلاءً بسبب نية البيع، ساريًا حتى 9 نوفمبر 2023. وقد أرسلته محاكم دبي، وأقر المستأجر السابق بذلك.

يرفض المستأجر الجديد المغادرة وقال إنني يجب أن أقدم لهم إشعارًا جديدًا لمدة 12 شهرًا.

لا أريد إرسال إشعار جديد، حيث لا أخطط للعيش في العقار، أخطط لتأجيره (يدفعون 42 ألف درهم إماراتي أقل من السوق ولا يغطون حتى الرهن العقاري) لبضع سنوات قبل الانتقال إليه.

أسئلتي:

أ) هل يمكنني إرسال خطاب قانوني من الكاتب العدل، بالإشارة إلى الإشعار السابق الذي لا يزال ساريًا، من محاكم دبي؟

ب) إذا كان الأمر كذلك، فهل يمكنني إخلاءهم قانونيًا في التاريخ المتفق عليه، وهل ستكون هيئة التنظيم العقاري في صالحي؟

ج) إذا غادروا، هل يمكنني تأجير العقار؟

لم أذكر أبدًا نية الانتقال في الإشعار، حيث كان إشعار المالك السابق هو "نية البيع".

You can't evict the tenant for the purpose of renting it again. This will create a problem for you.

The reason for the eviction notice should be selling or the landlord wants to move in, not to re-rent it.

According to the provisions issued by the RDC, the current owner benefits from the legal notice sent by the previous owner and assumes all rights and obligations arising from the tenancy relationship.

Therefore, you can utilize the notice you mentioned, but under the same conditions. This means that if it was a notice for eviction due to a sale, it must be used for the same purpose.

However, if you intend to evict the tenant for the purpose of re-leasing the property, this notice would not be valid, nor would the new notice you intend to send.

The law has specified certain exclusive cases for eviction, which do not include rent increases. If you wish to increase the rent, you must notify the tenant at least 90 days before the contract's expiration.

The court's estimation will be based on the RERA rental calculator and the prevailing rents in the same area.
