Q: Hi,
I have put 5% deposit on a property in Dubai and I have also paid 2% DLD fees + OQOOD. I have more payments starting in 2 weeks but I can't afford to continue with the purchase.
Am I entitled to any money back?

I am going to buy an apartment in Dubai.
If I am going directly from the seller's broker, shall we both (seller and buyer) pay 2% each to this broker? And also it asks for a convenience fee of 5000 Dhs, what is it?

Assistance with understanding the MOU rights and obligations

Q: Could you kindly advise if it is correct to put in an MOU that I, as the seller will be penalized an amount equivalent to the deposit for not transferring on the expected date?
The MOU states that I would need to pay this to the buyer- also it states that the deposit cheque is refundable on the date of transfer- what does this mean?

Q: Hello,
I have signed an MOU where the buyer failed to complete the transaction as per the date of transfer plus the extension. Thus, the MOU expired. I have requested from the agency the 10% deposit cheque signed by the buyer.
They refused to give it to me and requested an extension without any penalties or price increase despite the market appreciation by 10%. What can I do to get the cheque legally from them?
I am already in a big issue because I already bought a bigger unit having in mind that my unit is sold. They are asking for an MOU extension but the prices went up and I request the fair price as per the market and they are refusing to pay the increase.
Appreciate it if somebody can provide me with feedback on these two points:
1- Can the agency hold the cheque and not give it to me? Aren't they violating the law here?
2- What can be done in this case and what would the next steps be?

The property mortgage was rejected and the seller refused to cancel the MOU

Q: Dears,
I was trying to buy a house in Dubai using a mortgage loan. I signed an MOU with the seller.
Unfortunately, the mortgage defaulted and I didn't get the expected loan amount. I requested for MOU cancellation, but the seller rejected and sent me a Notarial Notice to start legal action against me and to encash the cheque.
What should I do?
Should I hire a lawyer and prepare for legal defense?

I booked an apartment and did not get any contract. How to get money paid to real estate agent?

Q: I paid an AED 8190 booking fee in February, but the agent then failed to provide the apartment or even a contract which was to be signed on the 15th of March.
As per our agreement, I requested a refund. We had a back-and-forth, and then they gave me a cheque for the amount to be cashed on the 28th of March.
On the 27th, they messaged me to say not to cash the cheque. I feel I am being scammed. What do I do?

How to cancel an off-plan property contract and get the paid money back?

Q: Hi,
I bought an off-plan property from a developer in November 2022 and signed a sale and purchase agreement (SPA).
The handover is scheduled for 2026, and I have paid 20% of the total amount. However, my financial situation has changed and I can no longer afford to make the payments.
The developer has informed me that if I cancel the contract, I will forfeit my deposit and be liable for cancellation fees.
I would like to know if there is any legal way to cancel the contract and get my money back from them.

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan?

Q: Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.

We signed MOU to purchase a house on a mortgage and it got delayed. Can the seller ask for compensation?

Q: Hello to all.
We are purchasing a house with a home loan.
We signed the MOU on 31/10 and unfortunately, it took the bank approximately 2 months to complete the whole process.
Now the MOU has already expired and the seller is asking for an additional 10% security deposit as compensation for the delay.
It is not our fault as we don't have control over the bank approvals. Can they do that?
Are we protected from DLD in this matter as the property is under mortgage?

Dear Sirs,
I have a Reseller Contract which was signed between us and another party for the sale of 10000 units of Terminal Stations.
The final supply was to be done to the India Telecom over a 5-year period at 2,200 units per year, based on a purchase contract signed between us and another company.
Based on this agreement, we placed an order for 2200 units at a value of AED12,273,400 (Twelve million two hundred seventy-three thousand four hundred).
Based on the purchase order, the other party made a payment of 15% as a deposit and we finalized and handed over, but they didn’t pay since one year.
Kindly let us know if you can guide us how we can recover our funds legally.

Obtaining refund from the developer for project delay 0
I booked an off-plan studio in R.E.P. DIP. The developer posts to me the contract to sign. I signed the contract and posted it back to their address.
The texture property In Dubai has been dealing and I transferred 10% to reserve the unit in June 2015. I have paid over 30% until the end of Dec 2016.
I stopped paying the rest of instalments because after viewing 0% construction report through DLD website and neither developer has provided me Oqood.
There is still no construction as per the DLD report for project number 1514. I am considering to get a refund.
The total price of the studio is AED 330000. 10% at the outset, 36 equal instalments during construction, 20% on handover and 18 equal instalments after the handover.
I have paid 10% and 18 equal instalments out of 36 during the construction as per contract. Total AED 109,973.94 paid: AED 109,973.00
What are the possibilities to get a refund from the developer? How much would it cost?

Hi,
I have just found out I have a police case filed by my bank on a credit card payment. I have a credit card with 25k limit and could not do minimum payments for 1 year (due to job loss), nevertheless, the bank filed a case against me for 190k.
I do not understand on what ground and would like to know what to do. As well, how can I find out if I have a travel ban as I would rather try and solve the situation remotely from home than be concerned that I will be jailed here?

Hi,
I am staying in Abu Dhabi with my husband & 7 years old daughter. My husband was working in a big construction company from the year 1996. In October 2015, he got terminated due to which he went in depression.
He got another job but due to depression, he was not going to work regularly. The company terminated him. He doesn't have a job for 2 months & he is not in the position to look for the job as he has depression again.
He was having 3 credit cards. During his first job, he paid regularly without any delays. But after this new job, he didn't pay on time & even for 2 cards we were unable to pay for around 1 year. For the third card after checking with the bank, we had made installments but now for past 3 months, we didn't pay for it.
I really don't know what to do. I am also working but my salary is good enough for the rent only. Nowadays, our friends are helping us for the daily needs even.
Kindly let me know what could be the possible solution for this & can I send my daughter to the home country?
