Claiming the end of service benefits from the previous employer

I would like to file a complaint against a previous employer who did not pay my end of service gratuity.

The employer is based in DMCC, I am planning to get a NOC from DMCC mediation centre and then will file the complaint.

Can you please advise on the process to file a complaint and what documents are needed?

The case is simple, the employer did not pay the EOS, I simply want to claim it.

If the case is simple, do I need a lawyer or can I simply represent myself and have a lawyer prepare the letter to submit the case?

Thanks in advance

Dear Questioner,

Since you are working in a company under the free zone, please approach the Free Zone Authority and file a complaint.

They will take appropriate measures to settle it amicably. If your previous employer is not cooperating for the same, you approach Dubai Courts.

You can file the labour case even without the help of a lawyer. You will have to submit your labour contract, and bank statement to prove the last salary in order to calculate the end of service benefits.

Please note that you have not mentioned anything with regards to the nature of the contract or the duration of service.

If you need any further assistance, you may contact me.

Thank you.
