Q: Hello,
I am working for a manufacturing company in Dubai. The company is unable to pay the salaries on time for the last two years.
There have been several promises made that the salaries would come back to normal, but didn't happen till now.
Due to this, and even if the employee wishes to cancel the visa to discontinue his job here, the company does not give the full settlement during cancellation.
Whereas the employee is forced to sign the cancellation paper stating that he has received all his benefits from the company while getting only partial payment.
The company promises him that the remaining would be paid in the coming 3 to 6 months. The company fails to do so and leaves fewer options for the employee to challenge it legally.
What should be done in such case in order to receive all the money before we leave the company?

Employer's request to sign a clearance letter for unpaid dues upon termination

Q: I was a Project Manager for a company. After 9 years of my service, the company has terminated my services for the last 45 days (Because work is less & they want to downsize the staff strength).
I don't mind going back to my country, but they are expecting me to sign an Arabic letter stating that all my dues are paid, for the closure of my visa which is getting over on 07.10.2017.
Since the financial condition of the company is not good, they are not in a position to settle my gratuity & other benefits. They are not giving any clear-cut date on which they will settle my dues.
My worry is that once I sign the Arabic letter & my visa is cancelled, I cannot continue in the UAE beyond 28 days after visa cancellation.
I don't want to go against the company to pursue legal step, but at the same time, I am worried about my dues that I may be denied once I sign the Arabic letter & I am out of the UAE.
Please advise what I have to do?

Limitation period for labour related matters

Q: Dear Sir,
I have worked March 2008 to July 2011 in Mushrif National Construction LLC Central Market Project Souk - Abu Dhabi. My job designation was IT Assitant, my salary was Dhs 3200/- per month. Also, they have provided yearly two-way tickets and leave salary benefits.
In July 2011 I went to India for long leave. The company terminated me on January 31, 2012. After that, they calculated my indemnity money Dhs 6044/-. Partly they have sent my pending salaries and my indemnity money, they have sent only Dhs 2000/- till now. They did not pay my balance indemnity money Dhs 4044/-.
I have sent a lot of emails and mobile calls with no response from Mushrif National Construction LLC. Kindly please help.

The time limitation for unclaimed labour entitlements

Q: I was working for a free zone company in JLT Dubai, UAE and I resigned from the company around 12th Nov 2017.
Although I had a pending salary of 5 months, my ex-company assured me that they will pay my pending salary in instalments verbally and sent me a mail stating my pending amount.
So can I still file a case against my ex-company?

Q: Dear Sir / Madam,
I have been working here in Hamariyah free zone company as an Accountant Executive for the last one year.
For the last 5 months, I am not getting my salary. That’s why I wrote a mail to the top management regarding this issue to release my salary.
But the management was so rude and warned me not to ask for the salary. And if I am not happy with the company policy, I can resign.
I resigned already from the company with 30 days’ notice period, in spite of that, they are not releasing me. It is very hard for me to stay here without money.
Already 2 months finished but nobody is listening to me here in the company. Please tell me what can I do now?
Can I complain to Hamariya free zone labour department?
Please show me the right way where I can get help.

Q: My employer deducted visa money from my salary between March and October 2020.
I reported my employer to labor but the labor representative mentioned that it is over one year and thus, I cannot lay any claim anymore.

Q: Hi Sir/Madam,
I want to know what happens when I resign after I completed the probation period.
My company did not cancel my visa and did not pay me my gratuity and pending money.
It's almost 4 months and my visa is valid till December.
So how long do I need to wait? Or what is the maximum time to go to court for filing a case?
Is there any time period or I can go after 5 or 6 months?
Please guide me.
