فترة التقادم لرفع قضية عمالية

مرحبا يا هاري،

كنت أعمل في شركة منطقة حرة في أبراج جميرا ليك بدبي، بالإمارات، وقد استقلت من الشركة في حوالي 12 نوفمبر 2017.

على الرغم من أنه كان لديّ راتب مستحق منذ 5 أشهر، إلا أن شركتي السابقة أكدت لي شفويًا أنها ستدفع رصيدي المعلق على دفعات وأرسلت إليّ بريدًا مذكورًا فيه المبلغ المعلق.

فهل بإمكاني فتح قضية ضد شركتي السابقة؟

An employee can file a labour case within one year of his entitlements. Since you resigned on 12th November 2017, you have to file a labour case on or before 11th November 2018.

I request you to immediately take action and file a case before your right to file the case is barred.

Thanks for your quick and needy response.

I want to clarify one more thing. While cancelling my visa with the above company, I had to sign a paper in DMCC that stated ‘All my dues are paid’.

So will it create any problem in filing case?

Hello Sir/ Madam,

No, that will not create any hindrance whatsoever.

You can still raise a claim and the company has to prove they have made the payment (via bank transfer or WPS), which obviously the company cannot prove.

Your claim stands well.
