Pending labour dues and the legal way to claim them

Please, what should I do?

I've finished my contract and my Emirates visa will expire this 5th of November, but my employer refuses to settle all my benefits and he's owing us about three months salary.

His reasons are that he's waiting for clients to pay him money to clear me.

So many people finished their contracts before me and they are not yet settled, they have been staying in a room for over three months overstay and I don't want to stay in such a way.

Dear Sir,

Thank you for getting in touch with me on this.

I completely sympathise with you and understand your situation.

You need to immediately file a labour case against your employer to pay the pending salaries plus end of service benefits.

Considering you have been unpaid for three months, you will be eligible to claim an additional three months' salary as compensation in lieu of compensation for arbitrary termination.

Hence your claim should be pending salary, EOSB, three months salary as compensation plus air tickets and all of this at 9% legal interest.

You must suggest your colleagues to file this as well instead of accumulating fines for overstay.

You can contact me at 052 9495731 or email on hari@alnassaradvocates.com for further guidance.

I trust I have dealt with your queries.

Regards,

Hari Wadhwana
