Legal action by the bank for defaulting on loan and credit cards

Hi Sir,

I am an Indian national, I had to resign from my job 6 months back and leave the UAE due to health reasons. I am unable to go and work in the UAE.

I have a personal loan of 120,000 and credit cards of 97,000 and not paid my personal loan and credit card dues for 2 months. I do not have an intention of returning to Dubai soon.

Will the bank deposit the security cheques and take an arrest warrant?

Will I be able to request a settlement of as I can pay 50% and close these accounts?

Thank you for getting in touch with me on this.

After reading your query, my response is as follows:

In normal circumstances, upon non-payment of dues, the bank will deposit your cheque and gets it bounced (in case of insufficient funds). Thereafter, the police case will be filed against you.

Upon the police case being filed, your name will be flagged before all government authorities (police, immigration etc). So whenever you will travel to UAE, you will be apprehended and made to pay a fine.

There is a fine because the amount is below AED 200k (individually and not cumulative AED 200k)

I suggest you settle with the bank and close this matter, and when it's done, the bank will withdraw its police case.

Dear Questioner,

With reference to your inquiry, kindly be informed that, since you have no intention to return back to Dubai, then, your situation will not be jeopardized, unless the bank has a branch in India, or has referred the issue to a VERY CLEVER collection firm.

As for depositing the cheques, of course, that will happen someday since all the banks go for that option eventually.

And for settling with the bank via paying 50% out of the entire amount, it all depends on the bank itself, and whether it will accept the same or not.

But it's most likely to be accepted. You should try contacting them and offering them whatever you have got.
