Liability of son for a guarantee cheque issued for father's debts

My father was under a medical condition and was treated for cancer last year. He had borrowed his company's money and could not return back.

As he was having cancer and we were going to India back, they asked him to repay the money. But instead, as I am his son, he informed me to give my cheque as surety as he had no cheques.

Due to my father's condition, I gave my bank cheque for the amount to be repaid. In some months we have only paid 40% but 60% is pending which his company has held my cheque and might put anytime to the bank.

We are buying time but can't to pay back as It is a big amount. What legal action can the company take as I am not responsible? How is that I can get out of this or find a solution as per the UAE law.

Dear Questioner,

I completely understand your situation.

Please note that you will have to face the criminal liability part since you have given them a cheque signed by you.

Anyhow, we can defend the matter in the civil case [if the company files a civil recovery case against you] because you have no civil liability against your father's debt.
