How to transfer son's sponsorship while ex-wife refuses to hand over her Emirates ID?

Dear Sir/Madam,

I am a French national who divorced my Dutch wife in Dubai under Dubai law. We have been divorced for 7 years and have a 15-year-old son. Until recently (December 2022), our son was under my ex-wife's sponsorship.

However, her visa expired in December last year and she has not renewed it. As a result, both our son and my ex-wife have been overstaying for the past 6 months.

I have informed her that I can and should sponsor our son, as I am the legal guardian and the legitimate father.

However, she has not been willing to hand over her Emirates ID so that I can transfer the sponsorship and apply for visa renewal and health insurance.

I simply need to be able to transfer the sponsorship of the expired visa in order to process the residency visa renewal for my son, who needs to be registered for the next school year and needs health insurance as he is currently not covered and is on overstay.

You may submit a request to the Personal Status Court to force his mother to hand over his identity papers to you.

Since you are the legal guardian, the emergency judge can order her to give you her Emirates ID so that you can proceed with the sponsorship transfer.

As for her own residency, you are not obliged to do anything.

Dear Client,

If the guardianship is for the mother, then she must agree to renew the residence permit and transfer it to your sponsorship.

There is another procedure to remove the damages and protect your son in order to secure and educate him, which is resorting to the court to enable you to do so.

Our son is 15 years old now, and I am the father. His mother's visa and our son's visa were under her own sponsorship.

Her visa and our son's visa expired 6 months ago. The mother has not renewed her visa and is currently overstaying, and by default, our son is also overstaying.

The mother is not willing to give her physical Emirates ID so that I could apply for our son's visa under my sponsorship.

Our son needs a new visa and a renewed Emirates ID for school registration. The mother is saying that she does not have her Emirates ID with her, although I have been asking for it for the past 6 months.

Can the court issue an order to the mother or to the immigration so that I can proceed with the visa renewal for our son under my sponsorship?

Yes, dear, you have the right to do so the court can give you the renewal order for your son's visa under your sponsorship and make him legal in the country.
