المطالبة بالاستحقاقات من صاحب العمل بعد استلام التسوية النهائية

مرحبًا،

لدينا موظف سابق أُنهيت خدمته في فبراير الماضي، وقد حصل على تسويته النهائية وانتهت تأشيرته في أبريل.

قام مديرنا السابق  بعد ذلك بتجديد تأشيرته في مايو لأمور شخصية. لم يذهب إلى العمل من مايو إلى يوليو، وبحلول نهاية يوليو، فتح قضية بينما كان المدير السابق خارج البلاد.

يطالب برواتب 3 أشهر و 3 أشهر تعويضًا عن الفصل التعسفي.

Please note that we will need complete information from you about this employee's termination and renewal of visa by your manager.

There appears to be a good defence in law considering your employee never reported to work after visa renewal.

You will need to appoint a lawyer to defend your case in order to evade liability or else there will be a judgement against your company and there are chances that the court may impose a travel ban on the manager.

Dear Questioner,

I believe if what you mentioned is correct, your previous manager acted in bad faith and you have a case against him for mismanagement and taking a decision against the company's best interests.

On the other hand, and in regards to the labour case, your company must present all facts to the court, including receipts of the payment to the final settlement to defend its position.
