The public prosecution has appealed for a more severe punishment. What to do?

Dear Sir/Madam,

I am involved in a drug case for possession and use of illegal substances.

I was bailed out on February 17 and had a court hearing on April 17, which I did not attend. The judgment was made in absentia, with a penalty of a 5000 dirham fine.

I paid the fine before the Eid holidays, and the "wanted" status was cleared.

However, the public prosecution has appealed the judgment, arguing that the penalty was too lenient. I have another hearing on May 17.

Should I file an appeal now or after the hearing on the 17th?

Dear Questioner,

You cannot file an appeal now. An appeal on your part was possible within 15 days of the issuance of the court ruling.

If you did not attend any court session, did not submit your defense in court, and the judgment was issued in absentia, then the appeal period starts from the day you are notified of the judgment or the day the judgment is executed and the fine amount is paid.

The judgment was made on April 17th and the fine was paid on April 18th.

The public prosecution appealed on April 25th. Is there anything I can do?

Should I attend the hearing on 17th May or can they imprison or deport me that day?

If the initial judgment was fine, and you paid the fine, then you have executed the judgment, and nothing will be issued against you until the judgment of the Court of Appeal is issued.

You can go to the appeal hearing with peace of mind.

Conversely, your presence in court gives the impression that you are interested and remorseful, and you can talk to the judge, ask him for mercy, and announce remorse.

You can go on your own, and you can hire a lawyer. It's up to you.

In the first session, no judgment is issued.

You can not appeal the final judgment but can do causation after the appeal judgment.
