Can I file a labor case in Dubai against my ex-employer located in Abu Dhabi?

I want to file a labor complaint to the court against my previous employer for pending salary issues. I resigned and joined another company.

My ex-employer's location is in Abu Dhabi. Currently, I am working in Dubai on a free zone visa.

Do I file a complaint in Dubai?

The complaint is submitted at the place of residence or work of the defendant so that your claim is not subject to rejection and lack of jurisdiction.

Therefore, it is best to file a case in the Emirate of Abu Dhabi, the Labor Court.

Hi,

You must file the complaint on the basis of where you are working.

If you don't mind kindly share your employment contract and visa copy for us to review the same.

Thanks!

Should you have any queries, contact us by phone.

I raised the complaint in MOHRE on Jan 5th 2023 with my previous employer for salary, ESD & Leave salary pending.

The complaint was withdrawn based on the employer agreeing to settle my pending salary/end of service benefits in a three months installments starting from Feb- 2023 to April-2023.

As per the employer commitments, I didn't receive my first installments. So I re-opened the complaint on Mar 14th 2023.

I still have not received any proper response from my previous employer. So MOHRE asked me to transfer this case to court.

I contact Enjaz in Abu Dhabi to inform me to register in Dubai. And I contact Al Adheed in Dubai to me to register in Abu Dhabi. I am confused which one I have to follow.

It does not apply in Abu Dhabi, and in any case the case is followed up online.

The worker can submit a complaint to the Ministry of Labor over the phone 80060 or the website (www.mohre..gov.ae).
