Rights of the employee upon termination without a valid reason

Sir,

What are my rights (terminal benefits) when terminated from employment as the company does not require my service?

There are no negative records in my service period and the company is now trying to reduce the cost as they have fewer jobs than expected.

I have worked for 2 years and 4 months (stamped second visa).

How will it be if termination with immediate effect and/or immediate termination with the salary in lieu of one-month notice?

Dear Sir/ Madam,

Thank you for getting in touch with me on this.

As stated by you, the company is terminating you from employment and it appears that there is no valid ground for such a termination.

You will be entitled to 3 months' salary as arbitrary termination, one-month notice period salary, gratuity for 2 years, salary for leaves if any. All these amounts with the legal interest at 9-12%.

You can get in touch with me for further queries and filing your labour claims.

Hello Sir,

Thank you very much for your advice.

I'm trying for an amicable settlement. However, is this rule applicable to an unlimited contract?

Regards

Dear Sir/ Madam,

I am glad to hear that you are trying to settle the dispute. The above-mentioned rule is for unlimited contract only.

I suggest that you obtain a cheque towards your settlement amount as it will be better evidence.
