Can the landlord breach the tenancy contract if I refuse a rent increase above RERA Index?

My landlord said he wants to increase the rent and I cited that the RERA Index does not allow them to do that.

He came back saying we can proceed through a rental committee to get a rental valuation, and if we choose not to, then he will:

(1) have one cheque instead of our original 3 cheques

(2) have me pay for the chiller though in the contract it says it's the landlord's responsibility.

Can he do that?

Hi

Pursuant to your query, the rental valuation is done only for the vacant property.

Since you are already living in this property, the landlord has to abide by the rental index.

Moreover, for any change in the contract he needs to inform you at least 90 days earlier in writing.

You can inform him in writing. If he still doesn't reply or agree, you can file a complaint in the RDC.

He will be able to do a rental evaluation but most likely the rent will not increase. But he cannot give the 2 other options.
