هل يمكن لمالك العقار أن يخرق عقد الإيجار إذا رفضت زيادة الإيجار بما يجاوز مؤشر مؤسسة التنظيم العقاري؟

أخبرني مالك العقار أنه يريد زيادة الإيجار، فذكرت له أن مؤشر مؤسسة التنظيم العقاري لا يسمح له بذلك.

عاد قائلاً إنه يمكننا التوجه إلى لجنة إيجار للحصول على تقييم للإيجار، وإذا رفضنا، فسيفعل ما يلي:

(1) يحصل على شيك واحد بدلاً من الشيكات الثلاثة الأصلية.

(2) يجعلني أدفع رسوم المبرد على الرغم من أن العقد ينص على أنها مسؤولية المالك.

هل يمكنه فعل ذلك؟

Hi

Pursuant to your query, the rental valuation is done only for the vacant property.

Since you are already living in this property, the landlord has to abide by the rental index.

Moreover, for any change in the contract he needs to inform you at least 90 days earlier in writing.

You can inform him in writing. If he still doesn't reply or agree, you can file a complaint in the RDC.
