Q: Hello.
I am working in a company in Abu Dhabi for more than one year now, and my pending salaries have not been paid for more than four months. Every time I ask them about the salary, they just tell me to wait.
I even have WPS, but no money comes in there too. I have told the owner of my company many times. They just delay from week to week.
Kindly help me and tell me what should I do next. I am in a lot of trouble already.

Filing a labor case for salary delay and forcing resignation

Q: My employer refused to pay salary (more than 3 months). Whenever I asked for the salary he told me to look for another job.
He is also forcing me to submit resignation letter and telling me: "cancel your visa by yourself".
Can I take legal action against this for pending salary? I already filed a case.

Non-payment of salary upon termination of employment

Q: I was working as a Civil Engineer in an Abu Dhabi based company since this June 2017. In this August, the company gave me suspension and then termination mentioning that I am not meeting their expectation.
The company called me to the office in this September to sign the cancellation papers. I told them to pay my salary and I shall come after to sign. When I asked my salary, the company sent me one document mentioning that from the work site some materials were missing and their cost is 30000 AED and it should be paid by me.
When I worked there, there were no issues. After 2 months of termination, when I asked my salary they are telling like this:
"The cost of these missing items is 30000 AED. So you have to give 22000 AED to the company net amount deducting your salary. Now, we will give you the offer - no need to give this 22000 AED, instead we will not pay your salary."
I did not sign the cancellation papers. Now the company opened a complaint in MOHRE Abu Dhabi against me.
What should I do?

س: أنا مهندس مدني أعمل في شركة مقاولات.
الشركة تدفع الرواتب متأخرًا بمعدل 4 شهور؛ فهي تدفع الرواتب شهريًا، ولكن بتأخير 4 شهور. بمعنى نحن في شهر 2 ننتظر راتب شهر 10.
ما حقوقي؟
وما كيفية تحصيلها بالقانون؟

س: تحية طيبة،
أعمل في شركة مقاولات وهي غير منتظمة بدفع الرواتب بتاتًا حيث إننا بالشركة نعاني مما يلي:
١- يدفعون الراتب كل ٤٥ إلى ٥٠ يومًا وأحيانًا تصل المدة بين الراتب والآخر إلى ٦٠ يومًا وأحيانًا يدفعون لنا نصف راتب فقط.
٢- منذ بداية عام ٢٠١٩، تم اقتطاع مبلغ ٣٠٠٠ درهم من الراتب دون موافقتي وإلى تاريخه يتم اقتطاع هذا المبلغ شهريًا من راتبي.
٣- هناك راتبين لشهري يوليو وأكتوبر ٢٠١٨ لم أستلمهما ورواتب ٥ أشهر لعام ٢٠١٩ إضافة إلى رواتبي حتى تاريخ هذا الاستفسار حيث إن مجموع الرواتب المستحقة يصل إلى ١٠ رواتب هذا غير الإجازات السنوية.
أرجو الإفادة بما يجب علي فعله. كيف أستطيع تحصيل حقوقي من هذه الشركة؟
هل أستطيع المطالبة بالرواتب المتأخرة منذ عام ٢٠١٨؟ وكيف ذلك؟
مع العلم أن عقد العمل الخاص بي غير محدد المدة ولكن لم يتم تجديده من قبل الشركة منذ شهر مارس ٢٠١٩.

لي رواتب متأخرة بالشركة لأكثر من 6 أشهر وانتهى عقد عملي وصاحب العمل يماطل في تسليم رواتبي المتأخرة ومستحقات نهاية الخدمة حتى انتهت إقامتي.
أصبحت مخالفًا. هل أستطيع تقديم شكوى في مكتب العمل والتقدُّم بطلب لإلغاء إقامتي؟

بمعنى آخر، دفع الرسوم المهنية بعد الانتهاء من المهمة. على أن يكون المحامي ذو خبرة في قضايا لا تزال في مركز الشرطة.

ما شروط فسخ العقد من قبل العامل بسبب تأخير الرواتب لأكثر من 45 يومًا؟
وهل يجب على العامل أن يدفع لصاحب العمل راتب ثلاثة أشهر إذا ترك العمل في هذه الحالة؟

Our internal contract has a notice period of 3 months from both parties. In the new labor implementation, only one month's notice is required for less than 5 years of service.
Please advise if we can follow our internal contract since the position is very curtailed and the organization will not be able to replace the position within one month.

Can you please clarify the correct annual leave salary rules?
Some say it is basic + HRA for the month you will take off, others say it is full salary, and somewhere I read it is basic + HRA (annual leave salary) plus the normal salary you get.

How to appeal the labor judgment if the court did not approve all my dues? 0
My employer has not paid my salary for 8.5 months. I went to the labor court, and was referred to Dubai Courts.
The judgment came and I did not receive the full claim including salaries and 3 months' compensation.
Please advise whether I can go for an appeal and what will be the time for execution.
