Q: 1) Since the company is a semi-government entity based in Abu Dhabi, can I challenge the unfair spot termination decision and get 3 months salary (per month salary was AED 7000) and other benefits?
2) Can I claim all my living costs (house rent, bills, car rental, food, telephone, travel/ fuel etc) after notice period finished date i.e. 26 April 2017 as per termination letter (21 days till 17 May 2017 and could end up more weeks)?
3) The termination letter was handed over on 29 March 2017 and last working day was same day but as per termination letter my last working day would be considered as 26 April (that is a difference of 3 days unpaid?)
4) As per my clear instructions to my team to report all necessary matters but in this case, everyone failed to report me and even many Rental Agents kept on renting this vehicle with a low tire pressure sign on the dashboard.
5) Shall I approach the labour court in Abu Dhabi or civil court considering my visa from immigration?

Q: Hello there,
I have been informed by my employer for 34 months, that my position is no longer required in our Dubai free zone office.
I was employed in 2014 to take up a Dubai-based position and I was informed that I would be taking over a Middle East Director in two years.
They have asked that I relocate to the UK in 3 months to take up the same position, they have given me 1 week to accept this offer.
Given that there is no mobility clause in my employment contract and offer letter, would I be within my right to refuse this offer on the grounds that it is unreasonable as we now know that it would take us (a family of 4 with 2 children) longer than 3 months to plan and move the family back to the UK?
What rights do I have if my employer were to make my position redundant, would I have grounds to sue for constructive dismissal as my performance has never been in question?

Am I entitled to compensation if my employer asks me to submit resignation?

Q: I have worked in a company for 3 and half years under a contract for an unlimited period. A month ago my employer asked me to sign on a resignation letter with immediate effect. He promised to give me a 3-month salary and other benefits.
After a month only gratuity and leave pay have been deposited to my bank account. As per the UAE labour law do I have the right to claim for 3-month salary?

Filing a labor case for salary delay and forcing resignation

Q: My employer refused to pay salary (more than 3 months). Whenever I asked for the salary he told me to look for another job.
He is also forcing me to submit resignation letter and telling me: "cancel your visa by yourself".
Can I take legal action against this for pending salary? I already filed a case.

How to claim labor rights and settle a loan after redundancy?

Q: I was asked to leave by a private bank that I was working for by saying that I have provided wrongful educational information.
This happened after 6 years of working for them. I was told that either I resign or they will write in my termination that I produced wrongful educational information/documents.
I chose to resign and my medical card was taken immediately. This was my only source of income and now they want me to arrange for the outstanding loan.
I did not provide any wrongful documents or information. How can I get my loan waived and claim my gratuity and other dues?

I have a question. My company has asked me to resign or I get terminated. I told them that I will resign once I find a job.
After one month today, they showed me a termination letter. Now they want my sign. I told them I will sign after deep consideration.

Asking an employee to resign to get better entitlements

Q: Good afternoon,
I have been working for a private big company for the past 17 years. This year, they have decided to put me in PIP (performance improvement) and they plan to fire me by end of November 2022.
HR BP had advised me to resign and he will help to increase the notice period up to 2 months with full pay. In the meantime, I can look for another job.
Also, he promised that I will take full gratuity without any cuts. As per him, it is in my favor to resign than get fired for not performing.
Kindly advise!

I am currently working for a free zone company in DAFZA. The job is not going well for me and I would like to leave. I signed a three-year contract and it has been nine months so far.
My contract states that I need to give one month notice but my employer wants me to stay for two months. He says it is company policy not to accept the breach of contract compensation, hence I must serve two months without pay.
I am supposed to pay him for three months half pay, and he is refusing to allow me to pay that and serve one month notice. I am even thinking of just absconding and going back to my country. Will I get a labour ban and immigration ban?
I received an offer from one of our clients as well, but my contract has a non-competition clause. Does this apply, given that the two companies are in different industries, one is a supplier of products and the other is a consultancy service provider?
I am considering going back to my home country as my employer is being unreasonable on the 2 months notice.

I am Sammy based in Nairobi, Kenya and I'm about to deal with an electric company in Dubai. I want to provide the company with business and in return, I get my commission from them after the deal is done.
My issue is that we may have an email agreement with them, but later after the business is done they may evade from sending me my commission. I need a letter whereby I and the company sign it as an agreement to avoid nonpayment.

Filing a bounced cheque case against a debtor 0
Dear Sir/Madam,
Greetings for the day.
I have given AED 150,000 to a known person (who is dealing with flat lease), on his emergency situation.
He said he will pay the amount in 3 months. As a security, I took the whole amount in cheque. Apart from that, he had given 3 cheques total for AED 36000 for 3 months.
After a month he left the country and didn't come back for 6 months.
Now, its been 8 months without giving me any amount and now he is here in Dubai. So, I contacted him for the money, and he told me "I don't have money, do whatever you want".
So, I thought of going in a legal way, where I deposited all the cheques of AED 186,000 and it got bounced today.
Please guide me through the legal process, and what is the chance of getting my money back?
Now, I am seriously in a very bad situation. I am about to lose my future in the UAE because of this issue.
Please help me out.

Refund of money paid for purchasing a beauty salon that never happened 0
Hi,
We are planning to buy a beauty salon and we have given the owner a deposit of AED 20k. After a week he asked for another AED 50k as he has dues that need to be settled with the landlord.
He gave us a cheque for AED 50k which bounced because the account has been closed a long time back as per the bank. It’s been 49 days and the transfer is not done yet. Can we file a civil case and ask for moral damage as we lost a lot of money since the business is not operating yet? Can we still get our AED 70k that we had given to him?

The employee's rights upon resignation from a government entity 0
I worked for a Federal Government entity in the UAE; this entity was created by special decree so it doesn’t have a normal trade license or Labour contracts from MOL. Instead, we have signed employment contract which states it is governed by Labour Law of 1980, other federal laws and will be in the jurisdiction of Abu Dhabi.
My employment visa is from the emirate of Dubai as the entity also had a branch in Dubai. I recently resigned from my job serving 3-month notice as mandated by the HR policy. My resignation got accepted within a day and I was advised that this day would be last working day, and my notice period has been waived off.
I was just short by 15 days in completing 3 years of my service, and I had planned by cash flows assuming I would be getting paid for the next 3 months. Now, I am in a very bad situation as the employer is insisting I am not legally entitled to 3 months pay.
I need your urgent advice on the matter as the Labour Ministry cannot get involved due to the absence of labour contract.
