As I understand, there is a genuine reason for non-payment and pre-mature filing of a criminal case as the due date was the 30th of July and they filed a case on the 22nd of July.

Please note that you will need to appoint a lawyer to represent you before the criminal court.

Points pertaining to merits and circumstances will have to be put forth and the court needs to be convinced that there exists a genuine case from your side.

Further, I suggest you have a lawyer in a labour case too. Considering a lawyer can be helpful in getting a speedy recovery of dues, which in turn will fund for your criminal case.

It is not disputed that you owe the bank and there needs to be an instalment plan to be put forth before the court for payment.
