How to still renting an apartment while the landlord sends a notice for evacuation?

Dears,

I am living in an apartment in Palm Jumeirah. The average price is around 250,000AED, I have rented it for 2 years at 140,000 (this year I renewed at 147,000 AED).

At renewal, it was clear that the landlord is very frustrated that I'm renting it lower than the market average. So, as expected, she sent a legal (from the court) notice asking me to free the apartment at the end of this year, which is 12 months from now, August 2023.

In the notice, she says that she wants to sell the apartment, but I'm 100% sure she just wants to get me out and rent it again at a higher price.

I am very much interested to stay in the apartment for 1 more year; until early 2024, or to renew for 1 more year, but as per the notice, we need to leave by Aug 2023.

I am willing to go to court if there is anything I can do.

You can take the legal route. but, as per law, the landlord can send a notice of evacuation. If you want to win the case, you have to preset strong reasons and proof to claim your right.

What happens if she doesn't sell the apartment, and she is just lying?

Can she rent it? Or she will not be able to rent before 12 months?

Dear sir,

Kindly be advised that you will have to follow the legal notice served by the landlord, however, if you found out that the landlord rented the apartment other than using it personally or selling it, you still have the priority to occupy the apartment for one more year by simply report her to RDC and attach the legal notice.

OK fair enough! One more clarification, please:

My renewal happened on Aug 2nd, 2022.

She sent me a legal letter yesterday dated Aug 31st, 2022, asking me to leave at the next renewal which is Aug 2nd, 2023.

In my opinion, that's not 12 months' notice. Does that make the notice invalid?

It depends on the judge's sole discretion since it was done during August, but I advise you to challenge the notice on August 23.

Hi sir,

As per the law, you need to vacate the property as per the notice. However, if after vacating the property you get to know the property is not sold, you can proceed to RDC and file the complaint against him with all the supporting documents.
