Breach of contractual agreement
A question of breach of contract; I signed a contract for my cars to be sold. They sold the cars, refuse to pay me my money. Taking it to UAE Arbitration court.
What are my chances and will this drag on beyond the arbitration?
It highly depends on the contract that was signed, the existence of the buyers who made such breach, the amount of information you have from them.
First of all, we have to see the contract to advise. Basically, a selling of a car and non-payment is non-fulfillment of the contract and is considered a breach but we will need to understand more about the circumstances to be able to advise properly.
On the other hand, going to Arbitration or Litigation is a legal process that requires some good information about the buyers who are currently in possession of the cars. I say this because in case you are not able to identify them enough or allocate them enough to sue them, then your way forward is very hard.
