Q: I have an unlimited contract with the employer and I have not completed the probation. Can I leave the company without notice or do I have to give notice, and can they ban me from working after that or not?

Q: I am working as an accountant general. This is my 3rd month after getting the visa. My employer is not satisfied with my work progress and always shouting at me. I am so afraid that he will dismiss me. Will I get any employment ban? After the cancellation of visa during the probation period, will I get any grace period to search for any other job?

س: السلام عليكم، أنا موظفة إماراتية أعمل في شركة خاصة. تعرضت لمضايقات من زميلة في العمل عدة مرات، وعند توجهي لمسؤولي وإخباره عدة مرات يقول لي اصبري ولا يتخذ معها إجراء، وعندما تشتكي هي مني يتحدث معي.  يوماً بعد يوم، زادت المضايقات وأخبروني أنهم سيأخذون لي حقي خلال أسبوعين ولم يفعلوا شيئًا. توجهت لوزارة العمل لتقديم شكوى وحل موضوعي. عندما عرف مديري قام بإرسال إنذار أول على الإيميل لأنني توجهت لمؤسسات حكومية وتقدمت بشكوى ضد موظفة. وقد رفع صوته عليّ وهددني أمام الموظفين قائلاً: "إنكِ تضرين نفسك" و"ممنوع تذهبي إلى الوزارة" و"ليس من حقكِ" و"سأتخذ فيك إجراء". بعدها بيوم قام بإجراء "إنهاء خدمة موظف" تجاهي والسبب، عدم اجتياز فترة التجربة ٦ أشهر. علمًا بأنه بعد ما اشتكيت في وزارة العمل قدم لي هذا الكتاب. عملت عندهم من تاريخ ٢/١/٢٠١٩ إلى ٢٦/٣/٢٠١٩. وكل يوم يتصلون بي من الشركة لأوقع على الإلغاء وأنا أريد أخذ حقي.

س: إنهاء عقد العمل محدد المدة خلال فترة التجربة وبالرغبة المتبادلة بين الطرفين. يوجد خطاب موقَّع من الطرفين ينص على التراضي والرغبة المتبادلة في إنهاء العلاقة خلال فترة التجربة؟ فى هذا الوضع، هل يتعرض العامل للحرمان؟

Q: Dear sir, I am an employer of a ladies' salon. I want to ask for advice on this below matter. Recently, we have hired an employee in Nov 2019. She has not completed the probation period; her contract is an unlimited contract. The employee does not have any discipline, how to talk with her? On 02/04/2020, without a notice period, I received a resignation in addition to asking to cancel the visa. So, in this case, how can you help me? Q: Respected Sir/Madam, I am working in an Ajman mainland firm with an unlimited contract for 1 year. I got an offer from another employer for the same position with a higher salary. My present contract stated that I have a probation period of 3 months. My questions are: 1) Will my employer be able to impose a labour ban if I do not fulfil the notice period of 3 months? 2) If I fulfil my 3 months notice period, is there any way that my present employer can prevent me from joining a new job? Q: Dear Sir/Madam, I'm still working with a company under probation, but they called me and insisted that I sign a termination letter. They also instructed me not to come to work tomorrow and sent a cancellation letter mentioning disciplinary action. I refuse to sign any warning letter or related documents. I'm concerned that signing the cancellation letter now might result in a ban. Additionally, I'm unsure if I'll be able to find another job at any company.

We try in this article to shed light on the changes introduced with the new labor law and their significance on both, the employer and employee.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
