A developer demands an amount not contained in the contract. What to do?

Dear sir/madam,

A developer sent me a demand note with an amount not contained in the contract agreement and when asked as to why this amount is demanded they replied that it is as per real estate legislation.

When again asked to quote that legislation, the amount was then removed from the statement, so is it an attempt of cheating and a financial crime by misguiding a foreign investor or a business as usual? And how can it be dealt with? And where to lodge a complaint?

Thanks!

Dear questioner,

You can submit a complaint in DLD. We can help you with drafting the complaint.

Please contact us via phone.

OK, but the website of DLD says no contractual disputes will be entertained so is there any other forum to get them to the criminal law?

Thanks!

Dear questioner,

If that demanded amount isn’t in the contract, don’t pay them, but that case needs a studying for the contract to give you the correct consultation.

That amount was deleted from the next statement. Not an issue of payment but the attempt of cheating a client is a criminal act or not?

No, it is a civil issue, but it is not enough reason to file a court case, only if you paid extra amount, you have to file a court civil case.

Oh, so here the attempt of cheating, fraud, and scamming is business as usual?

Very strange! In all civilized countries such an act is a criminal offense but not here. Bravo!

Dear,

This does not constitute a crime in any country. It may be by mistake, especially since the claim was not completed, and he did not get the money.

If he got the money illegally, yes this is a crime, and you can make a case against him. Also, if it causes you loss or damage, you can sue him.

Is it a mistake when they give the explanation that the amount is as per real estate legislation?
