Asking an employee to pay back the recruitment fees

Hi,

The company I work for says that as per the new law, even if I am 1-year plus, the company I'm joining has to get a refund (recruitment fees).

Is that accurate?

Dear questioner,

If you have passed the probation period and completed your contract and do not wish to renew for another term, you may, in accordance with the provisions hereof, move to work for another employer as per the conditions and procedures specified in the Implementing Regulation hereof.

In case you wish to terminate the contract after probation but before the end of the term, you need to provide a notice to your employer. The period is specified in your contract (30 to a max of 90 days).

If you do not abide by the notice period, then you need to compensate the employer.

The new labor law (federal decree law no. 33 of 2021) is effective from 2nd February 2022.

What if the company is requesting employees who passed their probation to pay the Visa/ hiring fee when they do not wish to continue their employment after probation?

Is that in accordance with the law?

No, it is against the law as the probation period has passed.
