ما هي فترة الإشعار في حالة الاستقالة وعدم النص عليها في العقد؟

سيدي العزيز / سيدتي العزيزة،

عقدي لا ينص على أي فترة إشعار لذلك استقلت من عملي. لقد خدمت فترة إشعار لمدة شهر واحد. تقول صاحبة العمل إنني بحاجة إلى العمل لمدة شهر إضافي وقد رفضت إلغاء تأشيرتي.

صاحب العمل الجديد يريد مني أن أبدأ العمل. ماذا علي أن أفعل؟

Dear questioner,

As per Article 43 of the new labor law (federal decree law no. 33 of 2021), either party to the employment contract may terminate the contract for any legitimate reason, provided that the other party is notified in writing and work shall be performed during the notice period agreed upon in the contract, provided that such period is not less than (30) thirty days and not more than (90) ninety days.

If your contract didn't state the notice period, so the minimum notice is 30 days.

It is best if you will contact the ministry of labor for clarification.
