The notice period is not stated in the labor contract. What to do upon resignation?

Dear sir/madam,

My contract doesn't state any notice period so I resigned from my work. I gave one month's notice. My employer says that I need to work an extra month and she has refused to cancel my visa.

My new employer wants me to start working. What should I do?

Dear questioner,

As per Article 43 of the new labor law (federal decree law no. 33 of 2021), either party to the employment contract may terminate the contract for any legitimate reason, provided that the other party is notified in writing and work shall be performed during the notice period agreed upon in the contract, provided that such period is not less than (30) thirty days and not more than (90) ninety days.

If your contract didn't state the notice period, so the minimum notice is 30 days.

It is best if you will contact the ministry of labor for clarification.
