لدي في شركة بالهند سندات أسهم USU******** بقيمة 200 ألف دولار أمريكي، و فائدة غير مدفوعة بقيمة 59 دولار أمريكي. تخلفت الشركة في مايو 2016 عن سداد القسيمة.

كنت أتواصل مع مجلس الأمناء بشأن هذا الأمر، واخبروني أنني بحاجة إلى 25 % من القيمة لكي أتخذ أي إجراء قانوني.

لذا فقد اقترحوا علي أن أنضم إلى مجموعة حاملي الأسهم، التحقت الآن بالمجموعة للتفاوض على إعادة هيكلة الدين.

قامت بالشركة بتوظيف استشاري. قامت الشركة ومجموعة حاملي الأسهم في فبراير 2018 بالتوقيع على اتفاقية دعم إعادة الهيكلة وتمت الموافقة على خطة إعادة الهيكلة.

ولكن في أبريل 2008 تم إنهاء اتفاقية دعم إعادة الهيكلة بسبب أن الشركة فشلت في الالتزام بهذه الاتفاقية ولم تحول المال ( حوالي 20 ميليون دولار ) إلى حساب الضمان حتى 20 أبريل. وإلى هذا اليوم لم تحرك ساكنًا.

في النشرة الدعائية للشركة فإن الشركة لها فرع في الإمارات، هل من الممكن تحصيل الدين بشكل ما؟

Usually, you may file an accountancy case against the company in order to get the real financial situation of the company, and accordingly, either you would file a criminal case if the accountant report reveals a fraud or breach of trust actions or you may file a civil case and obtain your rights.

Unfortunately, my russian colleagues Ms Anastasia and Ms Nargiza both are outside the country, but you may send me the trade license and the proof of your AED 200,000 plus the interest.

In addition, you can send a copy of RSA Agreement and any further details that you feel it is important and relevant to the matter.
