Q: I am seeking compensation for damages from a company that used my name in fraud.
I have finished the case until the appeal court and the execution court has ordered that the company assets and accounts be attached until they pay the sum required as per the judgement.
The company has been closed since last year and has no more money left in the bank.
If there are no more assets of the company I could go after since the company no longer exists, how else can I get justice aside from the words written on a few sheets of my case judgement paper?
I've spent a lot and exerted a lot of effort seeking justice for myself, and when it is time to collect what the judge has determined what I should have, apparently there is nothing left.
Is there any other legal recourse?
Thanks

Is it possible to claim labor dues and salaries after closing the company?
1
Q: Hi
My brother filed a case against his employer for not paying his final settlement and his few months' salaries. He won the case and he moved for the execution also.
But the thing is the employer changed his other business and property everything to his wife’s name and other people's names. There is nothing to attach.
Is there any solution to move forward?
Kindly advise

How to claim labor dues from the employer after filing execution case?

2
Q: I was employed by a company that couldn't pay its employees but kept promising us to hang on. The funding was coming. Many months of promising and the money never came.
I eventually left after working for them for 8 months. I opened a court case and eventually won the court case working through the Al Adheed Center (it's a lengthy process).
But still, the company has not paid. They were notified by a newspaper because the office is now closed down. I have no idea where the owner is. I have copies of his passport (he actually has 3 that I'm aware of) and his emirates ID.
I asked the courts to issue a travel ban against him, but they won't do it because the company trade license is now expired.
I can't believe I've spent about AED 15,000 on court costs, only to be told now that basically, he is going to get away with it.
What are my options?
What can I do?
35 employees worked and did not get paid. Some opened court cases, some chose not to.

Claiming the labor dues after judgment while all assets are sold

2
Q: Dear sir/madam,
We are five employees working for a Dubai-based LLC company. We had a labor case with the company. We won the case, and the court appointed an expert to sell the company's assets.
The process has been completed, but the GM had sold all the valuable assets in advance. As a result, there is nothing left in the company. When we checked with Al-Adheed (Dubai Court) for a travel ban, we were told it is not possible as it is an LLC company.
At this point, we (with a total claim of 300,000 AED) want to hire a lawyer to:
1. Check if we can request a travel ban or arrest warrant against the GM of the company.
2. We believe that he transferred the money to his personal accounts. So, we want to audit the two company accounts (FZC-AJMAN and LLC-DUBAI) for the last 5 years.
The company has mainly two branches, one LLC-DUBAI and FZC-AJMAN. Our visas were under LLC, but most of the invoices and payments were through the FZC account.
The owners and VAT numbers of both these companies are the same, and we have email and account statements to prove this.
Kindly advise!

After winning against employer, how to recover dues with insufficient assets?

3
Q: Dear Sir/Madam,
I have won a judgment in my favor against my employer for pending salaries, and the execution is complete.
The court has locked the employer's office, and an expert appointed by the court is tasked with selling the office assets to recover the money.
However, the office assets, including furniture and desktops, are valued at not more than 5000 AED, whereas my due amount is 100 thousand.
Please advise on how the court will recover the remaining balance from the employer.

View allTerminating an employee after sick leave and claiming compensation 0
Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to make the seller hand over the tenant's security deposit to the buyer upon completing a sale? 0
Should the seller in Dubai hand over their tenant's security deposit to the buyer upon completing a sale?
Who is responsible for managing this process?
At the time of the exchange, the broker said he would follow up with the seller and collect the deposit.
He hasn’t, and the seller has not handed over the deposit.

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
