Q: I am seeking advice on behalf of my sister. My sister's husband worked for a company in Dubai and was away on business in Singapore, on a free weekend he took a leisure trip to a Malaysian island and was, unfortunately, killed in an accident. The company said that the business insurance will not cover the accident due to it being a leisure trip whilst on business. They are also withholding access to his laptop, although it is a work laptop, she feels there might be important policies, accounts and documents on it that are online only with no paper documentation. She will need to visit the UAE to sort out his flat and belongings, close any accounts he may have had and visit his employer to recover any payments due and discuss insurance payments. She has asked me to see if I can find any legal advice relating to these matters and to ask if there are points to be wary of, and, once she is back in the UAE I guess she will need legal representation in these matters.

Q: I was involved in a car crash in my immediate line manager's car in Abu Dhabi. We were stationary at lights when a second vehicle drove at speed into the back of the car, I was thrown violently forwards and cried out in pain when the seat belt restricted my forward movement and my neck made a cracking noise. The traffic police attended and called for an ambulance to take me to the emergency hospital for investigation and treatment. I was strapped to a spine board with my neck held in a brace. I was x-rayed and examined by the doctors and was told I had torn muscle tissue in my neck, for this injury they gave me medication that the company paid for. Eventually, my condition worsened and after an MRI scan, it was found that further injuries had been sustained.The police report made no mention of my injuries, yet the hospital report said the police had sent me and that I was injured. The third party insurers decline any responsibility as no injury was mentioned in the police report. What can I do?  

Q: Dear Sir, My brother was involved in an incident at his company that claimed two lives (the victims died in a sewage tank). During this process, my brother happened to be a safety officer in that company but the supervisor and the managers assigned those workers who died during the cleaning of the sewage tank without informing the safety department. During the police investigation, my brother's passport was seized by the police and the case was referred to public prosecution. After the final investigation, my brother (safety officer) was not guilty as the public prosecutor decided, but the supervisor was guilty since he gave the order to those workers to carry out the unsafe work without informing the safety department for proper risk assessment. The supervisor was given a 5-month jail term. Concerning my brother, his case ended at the public prosecution office since he was not guilty, but since then, his passport is still held with the court. Please, I need advice. Thanks Taka Farhad

Q: Hi, I’m staying on sick leave due to a work accident. The medical treatment and wage loss payment are being covered by my company. I am wondering if I’d like to cease my employment before the treatment ends (as I am not confident to continue with working for this company anymore), am I eligible for compensation to cover further recovery or/and disability compensation? س: السلام عليكم، لدي عدة أسئلة: 1- راتبي 1800 درهم لا أتقاضاه كاملاً مرة واحدة؛ إذ أحصل على 1300 أو 900 ثم أحصل على باقي المبلغ بعد أسبوع. هل هذا التصرُّف قانوني؟ 2- حين أمرض أذهب للكشف وأحضر العلاج على نفقتي. أليست الشركة ملزمة بذلك؟ 3- دفعت في بلدي مبلغ 35 ألف جنيه، وحين أتيت إلى الشركة دفعت 2000 درهم باقي تكلفة الإقامة. يُخصَم مني مبلغ 500 كل شهر. هل هذا الخصم من الراتب قانوني؟ 4- نركب الباص 23 عاملاً. هل إذا صورت المنظر وقدمت شكوى أتعرض للضرر؟ لا أشتكي إلا للحفاظ على سلامتي وسلامة الآخرين. أرجو الرد في أسرع وقت!

The Insurance Authority has introduced a new regulation to regulate all electronic and smart insurance operations practiced by licensed insurance companies, insurance-related professions [such as insurance agents, actuaries, insurance brokers, surveyors & loss adjusters, and insurance consultants] and marketing insurance policies through banks to the extent applicable to their nature. The objective of this article is to briefly discuss the changes that are introduced by the new regulation.
