Can the partner of a deceased person take his assets if they were not married?

Will I ever get it as we were not married and he had no Will in the UAE or the UK?

Will the Sharia law be applied?

If you are not legally married, the transfer would not be possible.

Or else you need a Power of Attorney/NOC from his other legal heir(s) to get the proceeds transferred in your name.

I suggest you to please check with your bank where you hold a joint account with your husband if the operational mandate is Either or Survivor.

If it is so, you can still operate the account and probably transfer the proceeds.

1. You may please try to speak to your Relationship Manager with the bank

2. Get a notarised NOC from his living heir/s towards you. In that case, your sister can file the case for an Inheritance certificate through court and you can receive the proceeds.

It can be a normal letter (We can draft it for you).

It needs to be notarised and further attested by the UAE Ministry of Foreign Affairs and the UAE Embassy in London.

The NOC Letter should be in proper format and it is imperative that it should be notarised from your home country followed by attestations from the UAE Ministry of Foreign Affairs and UAE Embassy in London.

Emails will not suffice. Moreover, his sister also needs to give us a POA to run the case.
