Q: I'm a US citizen from New York currently residing in Washington USA with my sister.
I moved to Dubai around 3 years ago. I was working there but quit my job few months after I got married in Dubai on December 24, 2015.
My husband is from Pakistan and resides in Dubai. He was living in my apartment after our marriage.
As he physically and mentally abused me, I decided to leave Dubai, sell my stuff and come here to my sister. I had reported him to the police who had given him a warning letter.
My first concern is how can I make sure he does not take away my daughter? Either he may come here or he may try to gain custody through Dubai Courts. Please let me know how I can have full custody of my child.
Also now he believes he's free from any responsibility and said he will not give a single penny. Our daughter is 8 months old and US citizen as well. I need child support for my daughter. How can I get this?
For my husband divorce is a joke. He said it multiple times and threatened me also.

Q: In case of KHUL demand by wife, do I as a husband have the right to ask for compensation for all the expenses incurred during marriage and return of our gold given during marriage including mahr and money spent during marital life?
Is it mandatory for the husband to accept Khul when demanded by the wife for such marital discords?
In case of domestic violence by husband, what are the legal consequences here in the UAE?
And also what is the law for verbal abusive nature of the husband? There are phone recording and voice recording proof for this. Is it legal?

Filing a case against an abusive husband to return to home country with children

Q: My sister lives in Dubai. Her husband was convicted of murder and served time in jail for murdering their maid.
Yesterday, he tried to suffocate and kill my sister. She went to the police station and a hospital. He changed the locks on the door so that my sister can't come back home and be with her children.
He's also taken her passport and ID. She's in fear for her children. She's also in great fear of her life. She believes that if she goes back to him, he will kill her like he killed their maid.
She wants to go back to her family in Morocco and wants to bring her children with her so that they will be safe. Would she be able to go to Morocco with her children?
The law of Dubai protects women and children from abuse, and as such, the children should not be left with a convicted murderer and should be returned to their mother.
My sister should have the right to go back to her mother and father, to the safety of her family, with her children so that they can all finally be safe.
Please help!

Q: Dear sir/madam,
I have a case filed against me by my wife alleging using abusive language at the police station. She has also placed a travel ban on me through the police.
The matter is still under investigation by the police.
1. Will the above constitute a civil case or a criminal case?
2. My resident visa is up for renewal, will I be able to renew it in light of the above case?
3. What is the next step in the legal procedures to remove the travel ban and clear the case filed at the police station?

Filing for divorce by children due to continuous arguments between parents

Q: Hello,
I was wondering is it possible for my parents to get a divorce if I (21 years) daughter filed a report against them?
They have previously split up in 2019 and went to the family guidance (the report was regarding my father's physical abuse and cheating on my mother).
My dad can’t physically abuse my mom anymore due to court rules but he has been doing it mentally & verbally almost every day now, during daylight and literally after 12 am; it doesn’t matter with him.
I started recording some of their arguments when it was clear in June but sometimes it’s not possible so I listen through my AirPods live feature in case I have to step up.
He would argue over stupid things like why she won’t go out or accuse her of cheating or money issues, etc. They don’t get along and there is hate in between everything.
My siblings and I want them to get divorced; 3 of us are 18+ while the other two are 10 & 15.
I want them to divorce or stop my dad from living with us. We are exhausted. What can I do?

How can a woman file for divorce and child custody due to domestic violence?

Q: A friend of mine is in a difficult situation. She has a child, but the child’s father has kicked her out of their room and taken custody of the child.
The father is from Yeman. He has also been physically harming her—she has visible bruises—and has taken her Emirates ID and mobile phone, leaving her with nowhere to go, she has a job.
Currently, she is staying with a friend and is not allowed to return to her room.
Kindly request your advice on what steps she should take in this situation.

How can I reach a settlement with the bank for a mortgage of a jointly owned property? 0
I have a jointly owned property in Abu Dhabi. The mortgage was defaulted on as I had to leave the property with my children following an assault by my ex-husband. He left the country in 2018 and never paid the mortgage.
As I was in the country, the bank filed a criminal case against me, and I was sentenced to 3 years. I won the appeal against the bank and then filed another criminal case a few months later in Dubai. Again, I won and paid a fine.
In 2019, the bank started a civil case against me and my ex-husband to have the property repossessed. However, at the time of the purchase of the property, there were no Title Deeds, the bank requires this.
I cannot give them the Title Deeds to sell the property and pay back the amount owed to them as my ex-husband refuses to provide a POA. The bank has filed another criminal case against me only for our jointly owned property.
I wish to resolve this and pay off the bank and receive any money left from the sale. How can I resolve this issue of the Title Deeds?

Can a real estate agency hold a percentage of a property sale until transfer is done? 0
A real estate agency has signed an MOU stating that a 10% security deposit from the buyer and the seller will be kept in the real estate agency and will be released upon transferring the property.
The transfer of the property was blocked due to the court order.
According to my colleagues, the real estate agency is not a trustee and they are not allowed to have taken my security check in the first place, is this correct?
