Q: So there is this new law applicable on Jan 2, 2022, where convicts of bounced cheques will all be cleared and found innocent.
Question 1: Will this apply to civil cases that have passed all stages and are under execution?
Question 2: Will all this be cleared automatically or are there procedures to be done by the convict to fix and if so what are they?

I would like to know, are the cases closed automatically as per the new cheque laws, effective from January 2, 2022?

How to recover the amount of bounced cheques under the new law?

Q: Hi,
I have a cheque bounce from a person who owes me 63,000 AED. They are two cheques; one for 43,000 and another for 20,000 have bounced.
How can I recover my money? The person continues to ask for more time but it has been 4 months now and I no longer trust him.
Please let me know the timelines, also whether a travel ban will be imposed on him with the recent change in the law (decriminalization of cheque bounce).
Also how much court fees will need to be paid with the new law (with direct execution) and is it recovered from the other party?
Looking for urgent help on this, please!

Q: Hi Alona,
I had some loans from banks in 2015 which amounted to 400k from 3 banks. Now with the 2022 rule, I checked and there is no criminal case or travel ban against me which is a relief.
I plan to re-enter Dubai but I fear that the banks put again another case against me for these old debts based on the new commercial/civil law. Is the debt finished?
I don't want to get stuck in Dubai for old loans. Kindly advise on my possible course of action going forward.

A company loaned money from the bank and defaulted in the payment of return.
How long does a bank have to claim the amount in the UAE?
In the civil code, it's 15 years and in the commercial code, it's 10 years.
What would apply on behalf of the bank?

I need help!
A year ago, my previous employer filed a complaint at the police station accusing me of abuse. He did this because I had taken him to the labor court for not paying my salary.
The labor court case was resolved, and I received my salary. However, the police complaint is still pending. Initially, the police took my statement and informed me to wait for a court summons.
It has now been a year, and I have not received any summons. The case is still under police investigation. They have also informed me that there is a travel ban against me.
How can I remove this case from the police station?

I purchased a tenanted villa recently. Before signing form B, we asked the seller through the broker if the tenant could vacate the house upon expiry of the tenancy contract, and the seller said yes verbally.
So we signed form B, proceeded with the buying process, and confirmed as vacate house again with the seller during the final transfer.
We've sold the place we used to live in because we will move into this new house and stay in temporary accommodation until the tenancy contract of this new house expires.
However, now the tenant doesn't want to vacate the house upon expiry of the tenancy contract.
What can I do in this case?

How to recover commercial invoices pending with other companies 0
We run LLC construction and transportation company established in Dubai and Abu Dhabi. Both are separate companies.
However, there are companies that owe us nearly 3 million.
- Among the companies, one of them was executed in 2013 and paid us 26% (600k out of 2.3M) of the total amount.
- The second company was declared as defaulter 3 years ago and has to pay us yet. No execution has taken place. The lawyer was hired and the case is still with her.
- The third company, main-contractor and we as sub-contractor. Recently, the project got terminated by the client and owes us around 850k, no claim has been filed yet.
My question to a lawyer:
1. Can I re-open a case against the first company and transfer it to Saudi Arabia where they're based? I'm not sure if they still have projects in the UAE.
2. Do you see all these as a potential case that can be executed and handled by a single lawyer? If yes, I can email you all the documents and I would like to get feedback so we can proceed further.

Are property developers allowed to delay handover due to force majeure? 0
Hi,
The ACD mentioned in my SPA is October 2019, the developer further delayed the project to Feb 2020 and later again delayed to September 2020.
In August the developer delayed the project citing force majeure clause mentioned and said delayed due to force majeure and delayed it to December 2020
The clause mentioned in the SPA says either party has to inform about the force majeure within 30 days of the force majeure but developer informed only in August.
Can I claim compensation from the developer?
Legally, they are allowed to delay up to 12 months but can I claim compensation from October 2020 till date? The building completion certificate has now been issued.
