Claim against the company for holding passport and visa cancellation upon resignation

Hi.

I have worked as an accountant in one company in Abu Dhabi since Oct 2014 under an unlimited contract.

Last Jan 8, 2022, I have submitted my resignation, handed over all the data and completed my notice period on Feb 6, 2022.

Now my employer is saying the data are not proper and you have to wait until they finalize the financials.

They refused to cancel my visa and they hold my passport. Is it legal? Can you advise on what I can do?

I suggest you try to reach an amicable solution.

Failing that, inform them you have met your contractual obligation under the labor law by giving and serving your notice period.

And if they do not return your passport and cancel your visa, you will contact labor or more precisely, the Ministry of Human Resources & Emiratisation (MOHRE) to file a case.

You can check this advice on 800 60 but always try the amicable way first.

Hi.

Thanks for the reply.

They made a case against me demanding a handover.

The legal advisor from labor called me and I informed him I don't have anything to hand over.

He said to talk one more time with the company and if there's anything left, give it to them.

And if they refused again to cancel the visa please make a complaint.

My question is they are demanding me to work beyond the notice period. It's just like they hold me for the pending work.

If I make a case, do I have a chance to win considering I followed my contract?
