الإنهاء التعسفي لعقد عمل محدد المدة وحقوق العامل
مرحبًا،
قام صاحب العمل يإنهاء عقد العمل محدد المدة الخاص بي ( والذي ينص على فترة إخطار مدتها 30 يومًا ).
إنهم يتجاهلون جميع الاتصالات ويرفضون دفع الراتب المتأخر ومكافأة نهاية الخدمة ( 3 أشهر ).
يقولون إن وصل الأمر إلى المحكمة فسوف يتذرعون بالإعسار المالي، وذلك على الرغم من أن الشركة لا تزال تتداول وتتاجر.
هل هناك أي نصيحة بشأن خياراتي أو مستحقاتي؟ يتجاوز مبلغ المطالبة 200 ألف درهم إماراتي.

Sir,
This is a classic case wherein the Employer wants to evade making payments towards your salary and end of service payments.
Firstly, you will need to approach the Labour Court and file a case against your Employer for illegal termination (terminating your service without any reason) and breach of the term of labour contract (failing to give you 30-day notice period).
Secondly, your entitlement will be as follows:
1- Salary for your 30-day notice period,
2- Three-month salary towards illegal termination of service,
3- End of service payment towards gratuity,
4- Payment towards your paid leave, if any,
5- Airway ticket to your home country.
Also, you may be entitled to damages and hardship caused by the Employer, however, they are on the discretion of the Judge.
Please send them a legal notice and file a Labour case as soon as possible.
You will need a legal representation to file and defend your claims in the Labour Court.
