كيف يمكن إصدار توكيل رسمي إذا كان الموكل في الهند ولا يحمل تأشيرة إقامة في الإمارات؟

يحتاج صديقي إلى توكيل رسمي. الموكل موجود في الهند وهو مواطن هندي وليس لديه إقامة في دولة الإمارات.

الشخص الذي سيتم إرسال التوكيل له يقيم في دولة الإمارات بموجب تأشيرة إقامة وهو هندي الجنسية. التوكيل ضروري لبيع أو تأجير أو إخلاء عقار معين.

هل التوكيل الرسمي الصادر عن شخص غير مقيم مقبول في محاكم دولة الإمارات، أم أنه يجب استخدام الطريقة القديمة لاستخراج توكيل من الهند ثم توثيقه من وزارة الخارجية وترجمته؟

Dear Questioner,

As such, you need to draft a special POA from the owner of the property issued and notarized in the country he is residing in now, then the POA will be attested by the UAE embassy in the same country.

Then send the POA original to the UAE and one more attestation is to be done in the MOFA after the legal translation into Arabic is done.

Hello,

As per your query, nowadays POAs are made online.

Also, since the person who is residing abroad has property here, he/she should be holding property documents in their name and visa too.

Please try to do it online, and if it does not succeed, then you can do it the conventional way.

No as per the clearly mentioned statement, the person does not have UAE visa anymore. He is not a UAE resident.

So as recommended by other 3 lawyers, He has to do POA in India and have it attested by the UAE embassy in India and have MOFA and legal translation done on original in UAE.

I think this is the right answer.
