What do you need to sell or claim an asset of a family member living abroad?

Hi,

I want to sell my father's car because he can't come to the UAE due to COVID-19 situation and visa issues for Pakistan. I have tried to get a power of attorney from Pakistan. It just keeps delaying.

I don't know what's the issue there but till now it's not happening. For attestation, the authorities are asking to send the documents through TCS (A Pakistan Courier company).

Due to which, I am looking if there could be any other way here in the UAE by which I could be able to sell or gain ownership for my father's asset.

If there is any other way through I which can get ownership or authorization, please guide me.

I would really appreciate it.

Thank you.

Hello,

Thank you for your question.

If the car is located in the UAE, then an option to consider is notarizing the power of attorney in the UAE.

This will allow you to act on behalf of your father and in his interest in the U.A.E. One thing to keep in mind is the drafting of the power of attorney, as it should specifically mention the details of the car.

As a result of COVID-19, the Dubai Courts began accepting e-applications to notarize powers of attorney online. This was supposed to end last until April 9th, 2020; however, it seems to have been extended. You should be mindful that the Dubai Notary Public may accept or reject the applications at their discretion.

Should you require further tailored substantive legal advice, kindly send us an email and we will be delighted to assist you.

Kind regards,

Ludmila
